Terms of Service

1. Acceptance of Terms

By registering and using Velinari ("the Platform"), you fully accept these Terms of Service. If you do not agree, please do not use the Platform.

2. Service Description

Velinari is a software-as-a-service (SaaS) platform that enables the creation of digital wedding invitations, guest list management, RSVPs, seating arrangements, QR access control, and cash gift registry processing.

3. User Accounts

Users are responsible for maintaining the confidentiality of their login credentials. Velinari is not responsible for unauthorized access resulting from the user's negligence in safeguarding their passwords or access links.

4. Plans and Payments

Velinari offers per-event payment plans (Classic, Signature, Atelier). Payments are securely processed via Stripe. Payments are non-refundable once a plan has been activated, except in cases of technical failure attributable to Velinari.

5. Limitation of Liability

Velinari is not liable for: economic losses from incorrect platform use; errors in guest data entered by users; service interruptions caused by third parties; data loss due to force majeure or third-party attacks; indirect damages, lost profits, or reputational harm; content created by users including images or text that infringe third-party rights; or email delivery issues caused by the recipient's spam filters.

In any event, Velinari's maximum liability shall be limited to the amount paid by the user in the preceding 30 days.

6. Intellectual Property

Velinari and its design collections (Aura, Hacienda, Gala) are exclusive property of the Platform. Users retain all rights to content they upload but grant Velinari a non-exclusive license to store and display such content within the Platform.

7. Mesa de Regalos y Transacciones

El procesamiento de pagos a través de la función de Cash Funds es realizado por Stripe. Velinari no almacena datos bancarios y no se responsabiliza por errores, retrasos o disputas en transacciones procesadas por Stripe. El usuario acepta los términos de servicio de Stripe al activar esta funcionalidad.

8. Commercial and Agency Use (B2B)

If you use Velinari on behalf of an agency, event planning company, or as a professional Wedding Planner to manage events for third parties (end clients), you expressly agree that:

• Direct Liability: You are solely responsible to your end clients for any services provided. Velinari acts exclusively as a software provider (SaaS) and has no contractual relationship or liability towards end clients.
• Hold Harmless & Indemnification: You agree to hold harmless, defend, and indemnify Velinari (including its directors, employees, and affiliates) against any claim, lawsuit, damages, or legal expenses brought by your end clients, guests, or third parties, arising from logistical failures, service downtimes, or misuse of the Platform.
• Third-Party Data: You warrant that you have explicit consent from your clients and guests to upload, store, and process their personal data on our Platform, assuming full liability before any competent privacy authorities.
